I have a question that I am having trouble coming up with an answer, and as you  seem to be a intelligent bunch of people, I figured one of you, or many, could help me out.

It's an entirely subjective value judgement.  The law has to accept some degree of arbitrariness in this regard, but this is not unusual when the law has to deal with subjective value.
