Basically, explicit consent by all those effected/involved is the proper criterion, and no state &amp;quot;social contract&amp;quot; in history has come anywhere close to being based on explicit consent. Implicit consent is a nonsensical and morally bankrupt notion that people use in the attempt to justify a non-existant social contract.&lt;/p&gt;
